# Terms of Service

These terms govern your use of ByKaranteli. The short version: we publish measured market data, we show our method, and we do not tell you what to trade. Using the site means you accept what follows.

## What this service is

ByKaranteli is an information and data product. We collect derivatives and spot market data, compute indicators from it, publish datasets, and archive the collected history with its provenance.

It is not a broker, an exchange, a custodian, an investment adviser or a fund manager. We do not execute orders, hold assets, or manage money for anyone.

## Nothing here is investment advice

Everything on this site is general information published to the world at large. It takes no account of your circumstances, your risk tolerance or your objectives, and it is not a recommendation to buy or sell anything.

That applies to every channel we publish through: this site and its embeddable widgets, the API, the MCP server and any answer an AI assistant builds from our data, the datasets, the emails and digests you subscribe to, our posts and videos on X, Threads, Instagram, LinkedIn and Telegram, and the desk notes published on this site and in the app. Captions, summaries, desk notes, their translations and video scripts written by a language model from our own numbers, and the synthetic voice that reads them, are information, not advice, and can contain errors.

Trading leveraged crypto derivatives can lose you more than you put in. Past market behaviour, including any pattern our recorded history shows, does not predict future returns. Decisions you make are yours, and so are their consequences.

## Accuracy and availability

We take accuracy seriously and publish our methodology so it can be checked. Even so, market data arrives from third parties, feeds stall, exchanges revise history, and computed indicators can be wrong. Everything is provided as is, without warranty of accuracy, completeness or fitness for any purpose. To the fullest extent the law allows, we disclaim every implied warranty, including merchantability, fitness for a particular purpose, title and non-infringement.

We do not promise uninterrupted service. We may change, suspend or withdraw any feature. Where a change removes something members pay for, we will say so in advance.

## Calculators and simulators

The tools under /tools (position size, liquidation price, funding arbitrage, TWAP, the grid simulator and the DCA backtester) produce hypothetical results computed with hindsight from recorded prices or from numbers you typed. They include fees, slippage and funding only where a field says so, they ignore liquidity and execution, and they do not represent trades that were placed by anyone. No calculator output is a forecast, a recommendation or an indication of future results.

## Your account

- You must be at least 18 and legally able to enter a contract.
- One person, one account. Do not share credentials or resell access.
- Keep your email account secure. Anyone who controls your inbox can request a sign-in link or a sign-in code and therefore reach your account.
- Tell us promptly at support@bykaranteli.com if you believe your account has been used without your permission.
- We may suspend or close an account, or revoke its API keys, when it breaks these terms, abuses or attacks the service, or uses it unlawfully.

## The mobile app

- The ByKaranteli app for Android and iOS is free of charge and contains no purchases. It shows the same recorded market data as the site under these same terms, and nothing in it is investment advice.
- The app is distributed through Google Play and the Apple App Store, whose terms apply to the download and installation in addition to these terms. The stores are not parties to these terms and are not responsible for the service.
- Signing in with the six-digit code emailed to you opens a session on that device. Keep the code to yourself: it is as good as your inbox. You can end any session from the app.
- A membership bought on the site may unlock additional depth in the app where the store's rules allow it; the app itself never charges you anything.
- Push alerts are delivered on a best-effort basis through the platform's notification service and can arrive late or not at all, so do not rely on them as your only warning. To the fullest extent the law allows, we are not liable for a delayed or undelivered alert (see Limitation of liability).
- You can delete your account from inside the app; the Privacy Policy says what is removed and what has to be kept.

## Subscriptions and payment

- Membership is sold for a fixed duration, currently one, three, six or twelve months. It does not renew automatically and no payment instrument is stored, so nothing is ever charged to you without you starting it.
- Membership is paid in USDC or USDT on Solana. An invoice is valid for a limited window and expires if it is not paid within it.
- Pay-per-call API access and prepaid API keys (x402) are paid in USDC on Base or Solana per request through a payment facilitator; each call is priced before it runs and the price is shown in the payment challenge.
- Access begins when the transfer is confirmed on chain and runs to the end of the period you paid for.
- Blockchain transfers are irreversible. Once a payment has settled we cannot reverse it, and payments are therefore non-refundable. If something goes wrong on our side, for example a settled payment that did not activate access, write to support@bykaranteli.com and we will fix the access.
- You can stop at any time by simply not buying another period. Nothing further is taken.
- Prices, plan contents and limits may change. A change applies to periods bought after it, never to a period you have already paid for.
- Memberships are sold on the site only. The mobile app contains no purchases, and no membership can be bought, renewed or cancelled through an app store.

## Acceptable use

- Use the documented API for automated access, and stay within its published rate limits.
- Do not scrape the site in a way that degrades it for other people, and do not attempt to bypass rate limiting, authentication or paywalls.
- Do not republish member-only content, or resell any part of the service, without written permission.
- Do not probe, attack or attempt to gain unauthorised access to the service or its infrastructure.
- An AI assistant, agent or script that reads the API or the MCP server acts for the person who runs it, and that person is bound by these terms.
- Do not use the API, the MCP server or the x402 catalog to copy the archive systematically into a substitute for ours, whether a database, an archive or a service. Personal and individual research use is open on every plan; commercial use requires the Business plan.

## Sanctions and restricted use

We do not knowingly provide paid services to a person or entity located or ordinarily resident in a jurisdiction under comprehensive sanctions, or listed by the United Nations, the European Union, the United Kingdom or the United States Office of Foreign Assets Control. If a payment reaches us from an address that appears on such a list, the service is not activated and the funds are handled as the applicable law requires, which may mean that they cannot be returned. Do not use the service to evade sanctions or export controls.

## Data, licences and attribution

We serve three kinds of data. ByKaranteli data is what we compute: aggregates across venues, indices, scores, premiums, the liquidation model, our own node's readings and every other figure we derive. Public-source data is what regulators, central banks and public ledgers publish, such as CFTC positioning, central bank series and on-chain facts. Third-party data is a single venue's or provider's records as we received them, such as provider series and the raw records listed below. If you are unsure which kind a series is, ask support@bykaranteli.com before you use it commercially.

Datasets and API responses served from this site are licensed for personal and research use with visible attribution; commercial use requires the Business plan and redistribution of derived data requires the Scale plan (see /data#license and /developers#tiers). Those plan rights cover ByKaranteli data. Public-source data is credited to its publisher and stays subject to the publisher's terms. Third-party data is made available for your own use only: we do not own it, we grant no right in it, and using it commercially or redistributing it needs its source's permission.

Raw records (individual events, prints, position records, order book snapshots, minute bars and per-venue snapshots) are third-party data. They may not be redistributed under any plan, and using them commercially needs the source's permission as well as the plan. The Scale plan's redistribution covers derived data that neither exposes raw records nor lets them be rebuilt.

Files published on the GitHub, Kaggle, Hugging Face and Zenodo mirrors before 2026-09-10 were dedicated to the public domain under CC0, and that dedication stays in force for ByKaranteli's own computations in them. It does not reach third-party data in those files, which remains subject to its source's terms. The mirrors are no longer updated.

Everything else, including the site design, written analysis, the desk notes and their translations, member-only material and the collection software, remains ours. You may quote a desk note with attribution and a link to its page, and programs may use the note text served by the API and the datasets under the data licence above. Underlying market data belongs to the venues and providers it came from and is subject to their terms. Our permission never replaces theirs.

## Third-party sources

ByKaranteli is independent. We are not owned or sponsored by any exchange, data provider or index publisher whose data we show, and none of them endorses us. Some exchanges pay us a commission on sign-ups through our links (see Affiliate links). Their names and marks belong to their owners.

Third-party data is provided as is. We make no representation that it is free of third-party rights, or that any particular use you make of it is permitted by its source.

If you own or control data we publish and object to our use of it, write to support@bykaranteli.com. We aim to acknowledge within two business days and may suspend the disputed series while we review. Suspending or removing a source is not a breach of these terms. If it takes away a series during a period you paid for, we will say so and, on request, extend that period by the days the series was unavailable in it; that is the only remedy and it is not a refund.

## Indices and benchmarks

Our indices, composites and scores are published for information. Using any of them as a reference rate, a settlement price or a performance measure in a financial instrument, a financial contract or an investment fund is not permitted without a separate written licence from us, which we may refuse; a licence from us does not cover third-party inputs.

## Affiliate links

Some exchange links on this site are affiliate links, and we may earn a commission if you sign up through one. These are marked. Commission never changes what our data shows, because the recorders read market data and have no knowledge of any commercial relationship.

## Limitation of liability

To the fullest extent the law allows, we are not liable for trading losses, lost profits, or any indirect or consequential loss arising from your use of this service. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.

We are not responsible for the acts, failures or outages of exchanges, blockchains, wallets, payment facilitators, hosting providers or any other third party, including when their data is wrong, late or withdrawn.

Nothing in these terms limits liability for fraud or for anything that cannot lawfully be limited.

## Your responsibility

If you use the service in the course of a business, you will indemnify us against third-party claims, and against the losses and reasonable costs we incur from them, to the extent they arise from your use of data beyond the rights these terms grant you or from your breach of these terms. This does not apply to consumers.

## Changes to these terms

We may update these terms. The date at the top of this page changes when we do, and material changes affecting paying members are also sent by email. Continuing to use the service after a change means you accept it.

## General

- We may transfer these terms, the service and your account to a successor, for example a company formed to run ByKaranteli. You may not transfer your account or these terms without our written consent.
- We are not responsible for delays or failures caused by events outside our reasonable control, such as exchange or blockchain outages, network or hosting failures, attacks, or changes in law.
- If a court finds any part of these terms unenforceable, the rest stays in force. Not enforcing a term is not a waiver of it.
- These terms, the privacy policy and the plan details shown when you pay are the whole agreement about the service.
- If you send us ideas or suggestions, we may use them without any obligation to you.

## Governing law

These terms are governed by the laws of the Republic of Türkiye, and the courts of Türkiye have jurisdiction over any dispute. This does not remove any protection you have under the mandatory consumer law of your own country of residence.
